1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and BazaarDeal Technologies ("BazaarDeal", "we", "us", "our") governing your access to and use of the BazaarDeal mobile application, website at bazaardeal.in, and all related services (collectively, the "Service").

By creating an account, placing an order, or otherwise using the Service, you confirm that you are at least 18 years old (or have parental/guardian consent) and have the legal capacity to enter into this agreement.

2. Description of Service

BazaarDeal is an online marketplace platform that connects customers with local neighbourhood stores ("Sellers" or "Merchants") to enable discovery, ordering, and delivery of products. BazaarDeal acts as an intermediary technology platform and is not itself a seller of goods unless explicitly stated.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts

• You must provide accurate, complete, and current information when registering.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You must notify us immediately at support@bazaardeal.in of any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.
• One person may not maintain more than one active account without prior written approval.

4. Orders and Payments

Placing orders: When you place an order through BazaarDeal, you are making an offer to purchase products from the respective Seller. Orders are confirmed subject to product availability and Seller acceptance.

Pricing: All prices are displayed in Indian Rupees (INR) and include applicable taxes unless stated otherwise. Prices may vary by location and are set by Sellers. BazaarDeal does not guarantee the accuracy of listed prices at all times.

Payment: Payments are processed through secure third-party payment gateways. By making a payment, you authorise us to charge the applicable amount. BazaarDeal does not store full card or banking details.

Cancellations and Refunds: Cancellation and refund eligibility depend on the order status and Seller policy. Requests must be raised within the window specified in the app. Approved refunds are processed to the original payment method within 5–7 business days.

5. Delivery

• Delivery timelines are estimates and may vary due to traffic, weather, or other factors.
• You are responsible for providing an accurate delivery address. BazaarDeal is not liable for failed deliveries due to incorrect address information.
• Risk of loss and title of products passes to you upon delivery.
• Delivery availability and charges may vary by location and order value.

6. Seller Responsibilities

Sellers listed on BazaarDeal are independent businesses. BazaarDeal does not own, prepare, or quality-check the products listed by Sellers. Each Seller is solely responsible for the accuracy of their listings, product quality, and compliance with applicable food safety, consumer protection, and trade laws.

BazaarDeal makes reasonable efforts to onboard verified Sellers but does not provide warranties regarding the quality, safety, or legality of Seller products.

7. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable Indian or international law.
• Post false, misleading, or fraudulent reviews or content.
• Reverse engineer, decompile, or attempt to extract source code from the app.
• Use automated bots, scrapers, or crawlers to access the Service.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Harass, abuse, or harm other users, Sellers, or delivery partners.
• Place fraudulent orders or exploit promotional offers dishonestly.
• Upload or transmit viruses, malware, or any other harmful code.

8. Intellectual Property

All content on the Service — including the BazaarDeal name, logo, design, text, graphics, software, and trademarks — is owned by or licensed to BazaarDeal and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from any content on the Service without our prior written consent.

9. User-Generated Content

By submitting reviews, photos, comments, or other content ("UGC") to the Service, you grant BazaarDeal a worldwide, royalty-free, perpetual, irrevocable licence to use, display, reproduce, and distribute that UGC in connection with operating and promoting the Service.

You represent that you own or have the right to submit any UGC and that it does not violate any third-party rights or applicable law. We reserve the right to remove UGC that violates these Terms or our community standards.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• BazaarDeal provides the Service on an "as is" and "as available" basis without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to BazaarDeal in the three (3) months preceding the claim.
• We are not responsible for the acts or omissions of Sellers, delivery partners, or payment processors.

11. Indemnification

You agree to indemnify, defend, and hold harmless BazaarDeal, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the competent courts in India.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.
